Keith Dubanevich convinced U.S. District Judge Michael Simon to dismiss a case against firm client Legacy Meridian Park Medical Center and others.
The lawsuit was filed by a physician who had undergone peer review by the hospital’s medical staff. The physician subsequently filed suit asserting thirteen different legal claims. After some of those claims were dismissed, the plaintiffs offered to drop the case but later tried to avoid the offer. Stoll Berne asserted that the offer of settlement, once accepted, created a binding settlement agreement.
Judge Simon agreed and dismissed the case with prejudice.
