Living Social settles class action

bouton daily dealsA class action settlement has been reached in a class action lawsuit against Hungry Machine, Inc. d/b/a (“LivingSocial”) in the United States District Court for the District of Columbia.  The case is entitled In re LivingSocial Marketing and Sales Practices Litigation, Class Action Case No. 11-mc-00472-ESH-AK.  The complaint alleged that Living Social Vouchers used to redeem LivingSocial Deals are “gift certificates” and that expiration dates and other conditions applied to the Vouchers violate state and federal gift card and gift certificate regulations.

The LivingSocial Deal Voucher Settlement Class includes all persons in the United States who purchased or received any Deal Voucher prior to October 1, 2012.  A “Deal” reportedly includes items marketed, sold, or promoted exclusively on the LivingSocial websites, including products, services, gift cards or credit.

Under the LivingSocial Deal Voucher class action settlement, LivingSocial has agreed to create a settlement fund of $4,500,000 to be used to provide cash payments to Settlement Class Members who submit timely and valid Claim Forms.  Settlement Class Members each have the ability to recover a pro rata share of that fund up to 100% of the amount they paid for any LivingSocial Deal Vouchers that they still hold that the Settlement Class Member has been unable to redeem.  LivingSocial has also agreed to make changes to its business practices regarding LivingSocial Deals.
