Stoll Berne attorneys Josh Ross and Jen Wagner represented a beneficiary of several family trusts in two related litigation matters. In the first action, our client’s brother sued him seeking a declaration that our client had limited rights to real property alleged to be held in trust. The plaintiff abandoned his claim after Stoll Berne mounted a defense showing that the trust documents did not support the plaintiff’s theory. We also successfully negotiated a settlement that allowed the brothers terminate their joint ownership of the property. In the second lawsuit, our client’s nephew and niece sued him alleging that he had misused substantial trust assets. Stoll Berne defended the case by showing that our client’s use of trust assets was reasonable and permitted by the trust documents. The case ultimately resolved under terms favorable to our client.
