A class action settlement has been reached in a class action lawsuit against AT&T in the United States District Court for the Northern District of California (entitled Buccellato v. AT&T Operations, Inc., Case No. C10-00463-LHK). The lawsuit alleged that AT&T misclassified the Class Members as exempt from the overtime pay requirements of federal and state law, and consequently failed to pay them overtime pay.
AT&T Blue Sky Project Overtime Pay settlement class members include the following persons:
All people who worked for AT&T Operations, Inc. as part of the “Blue Sky” project anywhere in the United States in one of the following positions between February 1, 2008 and February 17, 2011: (1) Business Manager IT, (2) Senior Project/Program Manager IT, (3) Project Manager IT, (4) Senior IT Analyst, (5) Technical Architect, or (6) Technical Design Engineer.
The AT&T Blue Sky Project Overtime Pay class action lawsuit settlement provides that AT&T has agreed to pay up to $12,500,000 to cover the claims of Class Members who submit Claim Forms. The Court will hold a class action settlement Fairness Hearing at 1:30 p.m. on June 30, 2011, at the United States District Court for the Northern District of California, 280 South First Street, San Jose, California 95113, before Judge Lucy H. Koh, at which time the Court will consider whether the AT&T Operations Blue Sky Project class action lawsuit settlement is fair, reasonable, and adequate.
