Oracle Employee Overtime Pay & Meal Allowance Class Action Settlement Preliminarily Approved By Court

A $35 million class action settlement has been reached in a class action lawsuit against Oracle (“Oracle” or “Defendant”) pending in the Superior Court of Alameda County California.  The complaint alleged that Oracle failed to pay overtime and provide off-duty meal periods for certain quality software assurance engineers, customer support engineers and project managers who worked for Oracle in Redwood City and Pleasanton.

Class Action filed against Bank of America for Forced Place Flood Insurance

A federal class action filed in Oregon claims Bank of America forces home-buyers to buy more flood insurance than required by law, in violation of loan documents, through a former subsidiary that pays B of A kickbacks.  A copy of the Complaint in Arnett, et ux. v. On October 5, 2011 the Court entered an Order authorizing the Settlement Administrator to disburse the available net settlement funds (approximately $275,600,000) to pay valid claims of claimants in a class action lawsuit in the United States District Court for the Southern District of New York (styled In re Currency Conversion Fee Antitrust Litig., MDL 1409).  Read more…

If You Rented Online DVDs from Netflix, A Class Action And A Settlement With Wal-Mart May Affect You

The class action settlement reached between the class and Wal-Mart in a class action lawsuit against Wal-Mart Stores Inc. in the United States District Court for the Northern District of California (styled In re: Online DVD Rental Antitrust Litigation, MDL No. 2029) that we reported earlier about has now been preliminarily approved.  The complaint alleged that Wal-Mart and Netflix reached an unlawful agreement under which Wal-Mart would withdraw from the online DVD rental market and Netflix would not sell new DVDs that allegedly caused Netflix subscribers to pay higher subscription prices, according to the Wal-mart and Netlfix Online DVD class action lawsuit and settlement notice. UPS Customers balk at $4 million fee in overcharge settlement

I earlier posted a note about a settlement of a class action by UPS.  Two UPS Inc. customers objected on November 7, 2011 to a proposed class settlement in a suit in Alabama claiming the company overcharged for customer-measured shipments, saying the $4 million in attorneys’ fees constitutes an outrageous chunk of the deal.

Union Bank Checks Out Of Overdraft Fee MDL For $35M

Union Bank NA will shell out $35 million to withdraw from the multidistrict litigation in Florida accusing several banks of breaching contracts by unfairly charging customers exorbitant overdraft fees when they switched the order of processing the debit transactions to highest to lowest.  I earlier posted that Judge King had certified a class action against Union Bank.

This is the second bank to settle to get out of this litigation.  I earlier posted a note when Bank of America settled for $410 million.  Hopefully, there will be more settlements soon.
