A San Diego man has filed a class action against Yahoo, alleging that the company violated the federal Telephone Consumer Protection Act, which prohibits companies from sending unsolicited text messages to users’ mobile phones without their consent. The complaint states that in early January, the plaintiff received a series of text messages, purporting to be from Yahoo, and a Yahoo user, asking him to go online.
The lawsuit alleges that the plaintiff was unaware that Yahoo would send him messages, and that he did not consent to receiving them. The complaint says that Yahoo negligently and willfully violated the TCPA, and seeks statutory damages of $500 and $1500 respectfully, for each violation.
