Cigna Corp. asked the Third Circuit to reverse a district court’s class certification for policyholders denied coverage for an autism treatment, saying the claims involve significantly different circumstances and can’t be litigated as a group. The insurer, which is accused of wrongly refusing to pay for so-called applied behavior analysis it deemed experimental, says the district court erred in granting certification because it didn’t conclude that there was sufficient similarity among the insurance plans, the health problems or the medical treatments.
