New Balance Athletic Shoe, Inc. (“ New Balance”) has agreed to settle a class action pending in the United States District Court for the District of Massachusetts. The case is entitled Kimberly Carey, et al. v. New Balance Athletic Shoe, Inc., Class Action Case No. 11-cv-10001-LTS.
The complaint alleged that New Balance violated certain state laws and consumer protection statutes in connection with the marketing and sale of New Balance Toning Shoes and the benefits of wearing New Balance Toning Shoes. The New Balance Toning Shoes settlement class hopes to include all persons or entities that bought Toning Shoes from New Balance U.S. Retailers, New Balance Stores, shopnewbalance.com, joesnewbalanceoutlet.com, New Balance Outlets, or other third-party retailers from January 1, 2010 through August 29, 2012, unless otherwise excluded.
The settlement provides that New Balance will create a settlement fund of $2.3 million. This settlement fund will be used to resolve all approved claims submitted through the New Balance Toning Shoes settlement claim process.
On January 28, 2013, at 3:00 p.m., the Court will hold a Fairness Hearing at the United States District Court for the District of Massachusetts, before the Honorable Leo T. Sorokin, in Courtroom 24, John Joseph Moakley U.S. Courthouse, 1 Courthouse Way, Boston, Massachusetts 02210 to decide whether to approve the New Balance Toning Shoes class action settlement.
