On April 11, 2011, Tina Willis and Gary Willis filed a complaint seeking certification of a nationwide class action against Debt Care USA and Global Client Solutions. The complaint alleges that the plaintiffs lost their jobs, and became concerned about their ability to meet all the payments on their credit cards. They were desperate and heard about Debt Care USA. Debt Care USA said they would contact all the credit card companies, and would settle all their debts for about 50 cents on the dollar. All plaintiffs had to do was deposit about $1000 a month into what is called an SPA account. The SPA Account was managed by Global Client Solutions. Debt Care USA said they would charge plaintiffs 15% of the debt owed over time.
The complaint alleges that Debt Care violated a federal law called the Credit Repair Organizations Act. Plaintiffs seek to certify a nationwide class for this claim. The complaint also alleges that defendants violated an Oregon statute that regulates Debt Management Service Providers. Plaintiffs seek to certify an Oregon class for this claim. The complaint seeks a refund of all fees paid by class members.
